How to Start the Bankruptcy Process

Your Attorney will review your individual situation with you to determine whether Bankruptcy is a reasonable option for you, and what Chapter you may qualify for.

You need to schedule your appointment, and complete the Bankruptcy Questionnaire

  • It is not necessary that you have everything in the Questionnaire for your initial meeting,
  • However, the more you have, the better the attorney can advise you
  • You will need documents
  • You will need information about your debts
    • For each unsecured debt, you need:
      • Name of Creditor
      • Address
      • Account Number
      • Amount of Debt
    • For each secured debt, you need:
      • Name of Creditor
      • Address Account Number
      • Proof of secured interest (for home: mortgage; for car, car title, etc.)
      • Account Number
      • Amount of Debt
      • Value of the secured property
    • For Judgments or Lawsuits, you need:
      • Court Case Name
      • Case Number
      • Court name and address
      • Date of Complaint or Judgment
      • Amount of Claim
  • Your Income
    • Copies of your last 2 months pay stubs
    • Copies of your last 2 years tax returns
