Filing a Chapter 7 Petition

In order to file a Chapter 7 bankruptcy petition, you will need to provide certain information to your attorney. This will include:

  • Information about your assets
    • Monthly income from all sources
    • Any entitlement to inheritance / trust income / annuities
    • Any lawsuits or potential lawsuits
    • Any retirement / pension / IRA / 401K
    • Prepaid burial plots
    • Investments
    • Insurance policies, including any cash value
  • Information about your debts
  • Information about your budget expenses
    • Average expenses for utilities
    • Average expenses for food/laundry/clothing
    • Average expenses for mortgage/rent
    • Average expenses for insurance expenses
    • Average expenses for medical expenses
  • Information about the debts you seek to discharge
    • Name and address of creditors
    • Account numbers and balances
    • Any creditors you paid money to in the past three months

Gather Documentation

When you file bankruptcy, you will need to provide important documents such as:

  • Copies of deeds
  • Copies of vehicle titles
  • Copies of your mortgage
  • Copies of your pay stubs
  • Copies of your last two years tax returns
  • Copies of your debts, showing name, amount, address, account number
